The service
Social is a social media service for real estate agents, provided by PropertySimple Inc. (“PropertySimple”, “we”). Sam, your social media manager, helps you plan and make designs and posts, learns about your business in About you, and, when you connect your accounts, posts what you approve. You can also ask the PropertySimple team for help. AI tools work behind the scenes. Social may change, have interruptions, apply usage limits, or remove features as we improve it.
Social is for licensed real estate professionals and their teams. You must be at least 18 and able to enter a binding agreement to use it. Keep your sign-in secure, whether you use an email link, a password or your PropertySimple account, and use the service only for lawful business marketing.
Fees and renewal
Social is $149 a month, or included in PropertySimple One. Teams of 3 or more agents can choose the team plan instead, at $99 per agent a month. Asking for access is free, and your first week is free (your first 30 days on the team plan): you add a payment card when you start, and nothing is billed until 7 days (30 days for a team) after the PropertySimple team has confirmed your plan with you and your workspace, or your team, is ready, and if you cancel before then you pay nothing. Your plan is then billed through your PropertySimple account; the team plan is one bill for the whole team, counted by the agents on it. You can see your plans in your PropertySimple account, under Subscriptions.
Plans renew each month until you cancel. To cancel, use Subscriptions or email team@propertysimple.com. Fees are non-refundable, except where the law requires otherwise. We’ll tell you before a price change applies to you. Deleting your Social account doesn’t cancel a PropertySimple plan, so cancel it too if you no longer want it.
Your plan includes the daily limits listed on the Pricing page, such as how many designs and voice conversations a workspace can have each day, and we may adjust capacity to keep Social reliable.
Connected accounts and posting
An owner or admin of your workspace can connect your Facebook Page and Instagram professional account through Facebook’s own sign-in. Connect only accounts you are allowed to post to. Social posts to Facebook Pages and Instagram professional accounts today. LinkedIn, X and TikTok are coming.
Social posts only what you approve. Sam can prepare posts and suggest times, but you approve them, and each one goes out at the time you choose, outside your workspace’s quiet hours (9 PM to 8 AM in its time zone unless an owner or admin changes them), or right away with Post now. The one exception is Post new listings automatically, which is off unless an owner or admin turns it on: Sam then makes and schedules posts for new listings from your PropertySimple listings, up to 3 a week, and you can undo each one until it goes out.
When you approve a post, or turn on automatic posting, you ask Social to publish it to the account you chose. You are responsible for what is posted to your accounts and for following each network’s own terms and rules. If a network doesn’t confirm a post, Social checks its status instead of sending it again. You can disconnect an account at any time; posts scheduled for it are then held, and go out only if the account is connected again before their time. We may pause posting for a workspace, or for everyone, when that’s needed to protect you, the networks or the service.
Your content
As between you and PropertySimple, you own what you upload and the designs, captions and videos Sam makes for you. You give PropertySimple and its service providers permission to host, process, reproduce and transform that content, and to publish it to the accounts you choose, only as needed to run, secure, support and improve Social. We don’t use your content to train AI models. Improving Social means fixing problems and making it work better, for example from error reports, timings and how its features are used, or from a project you asked us to help with. It never means showing your content to other customers or using it in our marketing without your permission.
You are responsible for having the rights and permissions needed for the content you submit, the listing photos and details used in your posts, the people or brands you ask for, claims, offers, contact details, and the way you publish or use the work. Don’t upload confidential or sensitive material that your work doesn’t need.
Acceptable use
You must follow our Acceptable Use Policy. We may pause or end access when reasonably necessary to protect people, rights, the service, or our providers, including for abuse, security risk, unlawful conduct, or repeated attempts to bypass safeguards.
Disclaimers and limits of liability
Social is provided “as is” and “as available”, to the fullest extent permitted by law. We don’t promise uninterrupted availability, a particular design outcome, that a network will accept or keep a post, commercial performance, legal clearance, or that every feature stays the same.
To the fullest extent permitted by law, PropertySimple won’t be responsible for indirect, special, incidental, consequential or lost-profit damages arising from Social, and PropertySimple’s total liability for any claim about Social is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits rights or liabilities that can’t legally be limited.
Your responsibility to us
If someone makes a claim against PropertySimple because of your content, the posts you approve, or your breaking these terms or the law, you’ll cover PropertySimple’s resulting losses and costs, including reasonable legal fees, to the extent the law allows.
Law and disputes
Delaware law governs these terms and your use of Social, without regard to its conflict-of-law rules. Except where consumer law requires otherwise, the state and federal courts located in Delaware have exclusive jurisdiction over any dispute about them. These terms don’t create arbitration or a class-action waiver, and nothing in them limits rights the law doesn’t let you give up. If part of these terms can’t be enforced, the rest still applies.
Ending your account and changes
You may stop using Social at any time, and you can delete your Social account yourself, in Account, on the web or in the apps. Deletion is immediate and final: it stops your access, cancels posts that haven’t started going out, disconnects your connected accounts and deletes the workspaces you own. Posts already on your social networks stay there until you remove them, and your PropertySimple account stays too. Your Social sign-in is deleted with the account, so to use Social again you ask for access as a new customer would.
We may suspend or end access as described above, and we’ll use reasonable efforts to let you download your work when practical. Terms that logically survive, such as ownership, disclaimers, limits of liability, and responsibility for prior use, continue after access ends.
We may update these terms as Social changes. Material updates get a new date at the top of this page and, when appropriate, a notice in Social. For questions about these terms, email team@propertysimple.com, call or text (628) 210-8802, or use Need help? in your workspace. Our legal address is PropertySimple Inc., c/o The Corporation Trust Company, 1209 Orange St., Wilmington, DE 19801.
